University of North America, Inc. (UoNA) maintains this website located
at www.beliusa.info and its associated websites, web pages, content
and other materials (collectively the "Site") to provide
to you information about UoNA and its services. Your access to and
use of the Site is subject to these Terms of Use and all applicable
laws. By accessing the Site, you accept, without limitation or qualification,
these Terms of Use. The Terms of Use may be modified from time to
time and the terms as modified will govern your use of the Site.
Any new features added to the Site will be subject to these Terms
of Use.
Section 1. Generally
You are free to browse the Site. All material available on the
Site is referred to as "Copyrighted Content." You may
view and print portions of the Copyrighted Content for your own
internal use but not for resale or other commercial use and not
for use other than as provided in these Terms of Use. Copyrighted
Content may change periodically and at any time. The Copyrighted
Content is provided for informational purposes only.
Section 2. Privacy
UoNA collects information about you in several ways from different
parts of the Site. For instance, UoNA may collect information from
you so that you will receive its communications which may include
e-newsletters or online support to existing customers. Information
may also be collected when you communicate with UoNA through the
"Live Operator Help," "Contact Us," or "Employment
Opportunities" links on the Site. If you contact UoNA, it
will keep a record of that session. It will also maintain a copy
of your request or correspondence. Any personal information collected
from you by UoNA will be kept strictly confidential and will not
be disseminated to a third-party, without your expressed, written
consent. "Personal Information" is defined as your name
in combination with a credit card number, social security number
or bank account number. Personal Information is not information
that is publicly available such as your name, address, e-mail
address, telephone number, country of residence etc. or information
you provide in connection with your submission of your resume
or application for admissions.
UoNA may use any information gained through the Site to provide
maintenance and support to existing customers, customize Copyrighted
Content, fulfill your information requests, improve services,
contact you, conduct research and provide anonymous reporting
for internal use and to third parties. UoNA will not report data
in a manner that reasonably permits such information to be identified
with any user nor will it sell your information. UoNA may share
information it has about you with its affiliated companies or
business partners. UoNA will also use information it has about
you for internal record keeping and reporting.
Any material, information or other communication you transmit,
upload or post to the Site will be considered non-confidential
and nonproprietary and UoNA will have no obligation to preserve
the confidentiality or refrain from disclosing such communications.
UoNA and its designees will have no liability for disseminating
such content and will be free to copy, disclose, distribute, incorporate
and otherwise use the communication and all data, images, sounds,
text, product ideas, suggestions or enhancements, as well as anything
embedded therein for any and all commercial or noncommercial purposes
without your consent and without remuneration to you.
UoNA may set and access cookies on your computer for various purposes,
generally, to remind it of who you are and to access your account
information (if stored on its computers), to confirm your identity
as an authorized UoNA user, and/or to deliver to you more personalized
service. UoNA also collects IP addresses for system administration
to include them in outgoing mail message headers.
UoNA may disclose your personal information if it has reason to
believe that disclosure is necessary to identify, contact or bring
legal action to enforce any of its rights, including against you
or a third party, for nonpayment, violation of any agreement with
UoNA, to prevent injury to or interference with UoNA's rights or
property, to other UoNA users or anyone else that could be harmed
by such activities. UoNA may disclose or access account information
when it believes in good faith that the law requires it and for
administrative and other purposes that UoNA deems necessary to
maintain, service and improve it services and to protect its rights
or property. By accessing and using the Site, you agree that information
you have provided may be disclosed as described above or as may
be modified from time to time.

may have additional privacy rights then those included herein.
Section 3. Responsibilities of User
You are entirely responsible for all downloads, uploads and/or
emails transmitted via the Site. You should verify all statements
and do your own due diligence before downloading, uploading or
transmitting information via this Site. UoNA is not liable in any
way for any communications and links you may access located on
the Site. Nor is UoNA liable for any errors or omissions in any
Copyrighted Content or for any loss or damage of any kind incurred
as a result of the use of any Copyrighted Content via the Site.
You agree not to use the Site to:
(a) email, or otherwise transmit anything that is unlawful, tortious,
defamatory, vulgar, obscene, libelous, invasive of another's privacy,
racially, ethnically or otherwise objectionable;
(b) impersonate any person or entity,
(c) falsely state or otherwise misrepresent your affiliation with
UoNA or any other person or entity;
(d) manipulate identifiers in order to disguise the origin of
anything transmitted through the Site;
(e) email or otherwise transmit anything that you do not have
a right to transmit under any law or under contractual relationships;
(f) email or otherwise transmit anything that infringes any patent,
trademark, trade secret, copyright or other proprietary right;
(g) email or otherwise transmit any unsolicited or
unauthorized
advertising or promotional materials, chain letters or other solicitation;
(h) email or otherwise transmit any material containing software
viruses or any other malicious, computer code, files or programs
designed to interrupt, destroy or limit the functionality of any
computer software, hardware, telecommunications equipment or database;
(I) interfere with or disrupt the Site or servers or networks
connected to the Site or otherwise impose an unreasonable or disproportionate
burden on the Site;
(j) intentionally or unintentionally violate any applicable local,
state, national or international law, rules or regulations;
(k) attempt to circumvent any passwords or other security features
of this Site or take any action that would comprise the security
of this Site, its users or visitors;
(l) reproduce, modify, lease, distribute, sell, trade, resell
or otherwise exploit any portion of the Site or create derivative
works based on the Site.
Section 4. Indemnity
You agree to indemnify, release and hold harmless UoNA, its officers,
directors, agents, employees and affiliates, from all claims,
damages, fees and costs of any nature, including reasonable attorney's
fees, due to or arising out of any communication you submit, transmit,
download or upload through the Site, your use of the Site, including
any links located thereon, your connection to the Site, your violation
of these Terms of Use, or your violation of any intellectual property
rights. In the event you provide false, inaccurate or out-of-date
information through this Site, you agree to indemnify UoNA for
and hold it harmless from and against any and all liability, damages,
loss or expense, including reasonable attorney's fees, it may
incur, including but not limited to loss of business profits,
taxes, penalties or sanctions, interest, fees, costs and expenses
of any nature arising from or related to any claim, action or
proceeding alleged or initiated against UoNA by any third party
based upon the information you provide or your use of the Site.
Section 5. Modifications
UoNA reserves the right at any time and from time to time to modify
the Copyrighted Content, Terms of Use, the Site and/or discontinue,
temporarily or permanently, the Site (or any part thereof) with
or without notice. You agree that UoNA shall not be liable to you
or to any third party for any such action.
Section 6. Termination of User Rights
UoNA may, in its sole discretion, terminate your use of this Site
for any reason, with or without notice. You agree that any termination
of your access to the Site may be effected without prior notice,
and acknowledge and agree that UoNA may immediately deactivate
or delete your account and/or bar any further access to the Site.
Further, you agree that UoNA shall not be liable to you or any
third party for any termination of your access to the Site.

UoNA is not responsible for the content of other websites that
may have links on this Site. Furthermore, the terms set forth
in these Terms of Use no longer apply once you have left this
Site. Please note that you become subject to the practices of
those companies or individuals operating the linked sites. Please
use caution and review the privacy policies of any sites that
you visit to learn more about their information gathering practices.
UoNA disclaims all responsibility or liability for the availability
or accuracy of such the content of any external sites that are
linked to this Site. The inclusion of any link on this Site does
not imply that UoNA endorses the linked site. You acknowledge and
agree that UoNA shall not be responsible or liable, directly or
indirectly, for any damage or loss caused or alleged to be caused
by or in connection with your use of or reliance on any information,
goods or services obtained or available n or through any such
linked site.
Section 8. Proprietary Rights
All of the content on this Site, including the collection, compilation,
and arrangement thereof, is protected by all U.S. and international
intellectual property laws and may not be used without UoNA's express
written permission. This Site and any necessary software used
in connection with this Site, the collection, compilation and
arrangement of Copyrighted Content, all images, photography, graphics,
artwork, and other information found on the Site, regardless of
source, all Marks and other intellectual property relating thereto
and all information and data collected through the Site is owned
by Brydon English Language Institute, its parent, University of
North America, Inc.,its affiliates or other third parties who
have granted UoNA the right and license to use the Copyrighted
Content and contains proprietary and confidential information
that is protected by all applicable intellectual property and
other laws. All trademarks, logos, slogans, trade names and service
names, individually or combined with one another, and whether
or not registered are proprietary to UoNA, its parent or other
third party owners who have granted UoNA the right and license
to use its marks.
Section 9. Notices and Procedures for Making Claims of Copyright
Infringement
UoNA respects the intellectual property of others and strives to
investigate notices of alleged infringement swiftly and thoroughly.
Upon receipt of notice of an alleged infringement, UoNA will act
to remove any material found to be infringing or found to be the
subject of infringing activity.
If you believe that your work has been copied in any way that
constitutes copyright infringement, please provide all of the
following information:
(a) a description of the copyrighted work that you claim has been
infringed;
(b) a description of where the material that you claim is infringing
is located on the Site;
(c) your address, telephone number, and email address reasonably
sufficient and up-to-date to permit UoNA to contact you;
(d) a statement by you that you have a good faith belief that

Section 10. DISCLAIMERS AND LIMITATIONS OF LIABILITY
You agree that:
(a) your use of the site is at your sole risk
(b) the site is provided on an "as is" and "as
available" basis. UoNA expressly disclaims all warranties
of any kind, whether express or implied, including, but not limited
to the implied warranties of merchantability, fitness for a particular
purpose, non-infringement and noninterference with your use of
all or any part of the site.
(c) UoNA makes no warranty that (I) the site will meet your requirements,
(ii) the site and/or online services will be uninterrupted, timely,
secure, accurate or error-free, (iii) the results obtained from
the use of the site will be accurate or reliable, or (iv) the
quality of any products, site, services, information, or other
material purchased or obtained by you through the site will meet
your expectations.
(d) any material downloaded or otherwise obtained through the
use of the site is done at your own discretion and risk and that
you will be solely responsible for any damage to your computer
system or loss of data that results from the download of any such

(e) no advice or information, whether oral or written, obtained
by you from UoNA through or from the site shall create any warranty
not otherwise expressly stated or otherwise applicable pursuant

(f) UoNA assumes no responsibility for the change of services or
product offerings or pricing that has not been updated on this
Site.
(g) UoNA shall not be liable for any damages whether direct, indirect,
incidental, special, consequential or exemplary damages, including
but not limited to damages for loss of profits, goodwill, use,
data or other intangible losses (even if UoNA has been advised
of the possibility of such damages), resulting from: (I) the use
or the inability to use the site; (ii) the cost of procurement
of substitute products or services, data information or services
purchased or obtained or messages received or transactions entered
into through or from the site; (iii) unauthorized access to or
alteration of your transmissions or data; (iv) statements or conduct

Section13. Entire Agreement
These Terms of Use and any other agreements, whether or not referenced
herein, constitute the entire agreement between you and UoNA with
regard to and shall govern your activities and use of the Site,
superseding any prior agreements between you and UoNA. Please note
that you also may be subject to additional terms and conditions
contained in any contracts that you may have entered into with
UoNA.
Section 14. Jurisdiction
These Terms of Use, any other agreement with and the relationship
between you and UoNA shall be governed by the laws of the Commonwealth
of Virginia . You agree to submit to the personal and exclusive
jurisdiction of the pertinent state or federal courts located
within or with jurisdiction over Fairfax County, Commonwealth
of Virginia. Notwithstanding the foregoing, UoNA may seek equitable
relief, including preliminary and permanent injunction, in any
court of competent jurisdiction to prevent or enjoin misappropriation,
misuse, unauthorized disclosure or infringement of any intellectual
property rights. No bond shall be required as security for such
equitable relief. Such remedies shall not be deemed to be exclusive
but shall be in addition to all other remedies available at law
or in equity.
Section 15. Waiver
The failure of UoNA to exercise or enforce any right or provision
of the Terms of Use shall not constitute a waiver of such right
or provision. If any provision of the Terms of Use is found by
a court of competent jurisdiction to be invalid, the parties nevertheless
agree that the court should endeavor to give effect to the parties'
intentions as reflected in the provision, and the other provisions
of the Terms of Use remain in full force and effect.
Section 16. Headers
The section titles in the Terms of Use are for convenience only
and have no legal or contractual effect.
